What is Mediation?

Mediation is the process of settling disputes by having input into negotiating an agreement. The process is completely voluntary, and while it is permissible to bring legal counsel, an attorney is not required. A mediator serves as a fair, impartial go-between who confers with each party to help them arrive at a mutually agreeable decision. A most attractive benefit of mediation is that the process is confidential. Once a resolution is reached, mediation notes and other materials are not admissible in court or any proceeding. Only the signed agreement is provided to the court. This collaborative process is successful because each party has final input into the settlement.
